Battle Of The Keith Urbans And Rick Rubin Takes On Ray Stevens

  • If you’ve ever wanted to know more about Stoney LaRue than what you can gather from seeing him live, then head over to Texas Music Times. They’ve got a list of ten facts that most people probably don’t know about the guy.

    Fact #2–Female rejection was the source of his first-ever composition. “I sang ‘Walk Softly On This Heart Of Mine’ in a school talent show,” he recalls. “I was singing it to a girl I had a crush on named Sheila, and during the song, I looked right at her, but she was talking to a friend of hers the whole time. So after the show I wrote my first song called, ‘She Left Me Here All Alone.’ I had even won a first-place trophy at that talent show!”

  • Keith Urban the singer is suing another man, an oil painter, also named…Keith Urban. The singer says that the oil painter is misleading people to believe that he is actually Keith Urban the singer. The single quote that I could find that might possibly be misleading is “You have reached the site of Keith Urban. To those who don’t know, oil painting is one of my hobbies.” Keith Urban the singer wants the website shut down and the domain name transferred to him. Personally, I think Keith Urban the singer is grossly abusing his status as a celebrity by going after this guy. I don’t know if any steps were taken before the suit was filed, but someone from Urban’s staff should have emailed the guy and asked him to change his text a little so that it couldn’t be construed as misleading. If the singer Urban wants the domain he should have made an offer to the other Urban.
  • Everybody and their mom is publishing the story about Reba returning to the CMA Festival after an 11 year absence, so I felt obligated to do the same.
  • ScrippNews has some information on how Miranda Lambert spent her Christmas holidays in an article titled “Can’t take the ‘Texas’ out of Miranda Lambert.” Lambert says she spent seven days straight in her camo and no makeup.

    And behind the ready smile is a young woman who seems to have mastered the art of the girl-done-wrong-song. First there was “Kerosene,” a rocker about being fed up with romance, and now there’s “Gun Powder and Lead, a composition she completed while sitting in a class that would qualify her to get her concealed handgun license. “I really don’t have a chip on my shoulder most of the time, but I guess people think I do,” she says. “I’m from Texas so I automatically have a bit of that feisty attitude anyway.” She’s quick to point out that she scored a 100 on that test while her father _ a private investigator _ scored a 99.

  • Toby Keith will release his new album, Big Dog Daddy, on June 12. The album is produced by Keith, will be released on his record label, and will even have back up vocals by Keith.
  • Josh Turner talks about Me And God being a tribute to his grandmother, the woman who introduced him to country music.
  • James McMurtry hasn’t gained a significant amount of fame yet, but he frequently hits critic’s top ten lists. In an article on TheStar.com he talks about his biggest song to date, the politically charged We Can’t Make It Here.

    “I get a lot of nasty emails from people who don’t like it,” he said. “And in some places the song doesn’t get such a positive reaction when we play it, though we do it in every show.

    Representatives for Keith Urban (singer) have tried repeatedly to buy the keithurban.com domain from the painter. While I agree that the primary motivation for the lawsuit is obtaining the domain, it’s pretty clear that Keith the painter relies on confusion with Keith the singer to direct traffic to his site. Otherwise, why reject what has to be a generous offer for rights to the domain?

    I did a little digging and it looks like the painter registered the .com domain in May of ‘99, four months before the singer’s .net domain was registered in September. That’s five months before the singer’s debut solo album even came out in October of that year (according to Amazon).

    That being said, however, Archive.org doesn’t show a website being live until April of 2000. The content has changed only a little since that time, with the painter stating that none of his painting are currently for sale. The copyright text claims all rights are reserved by Keith Urban, Inc.

    So, the painter has the same name and even owns a company by the same name that is not in the same field as the singer, yet he should give up his domain because the singer got famous?

    So the painter was on the web first. I assumed as much, as the singer’s people would’ve tried to get the dot com name when they launched his site. So what? That doesn’t give the painter a right to piggyback on the singer’s celebrity. Why does the painter have references to Disney and Disney world in his meta tags? From what I can see, it has nothing ot do with the page content except for the large ad at the top. Why is every related site that’s listed on the directory Brady linked to a country music artists’ site? Given that keithurban.com has nothing to do with country music, it would seem that the painter is indeed benefitting from the confusion. For what it’s worth, I looked at archived versions of the site and for several months in 2002 it included a front page graphic of a young girl holding a guitar, with the caption “this is the latest digital art of my neice (Kayla Urban) who just turned 5.”

    I agree that Keith the singer is suing solely because his attempts to buy a domain that he dearly wants failed. Keith the painter has every right to the domain. However, it seems to me that he has written elements into the text and HTML of his site to perpetuate confusion with the celebrity or other things unassociated with his work and has done nothing with his website content to alleviate confusion that was obviously occuring. He left himself open to the singer’s extreme measures to get the domain he wants.

    I did a little further research after the things you mentioned, Matt. The large Disney World ad actually links to another site owned by the painter where he sells maps of Disney World.

    All of the related sites on the whois listing that I linked to are just a value added service provided by that specific lookup service. No person other than DomainTools has control over what gets listed there.

    Neither Google or Yahoo serves up KeithUrban.com in the top 20 results when searching for “Keith Urban”, so they serve relevant results. The only traffic the painter is receiving is from people that directly enter the URL in their address bar.

    We can agree on the fact that the painter has every right to the domain. I’m on the fence about whether or not he is perpetuating confusion and how obvious it really is. I think the only people really being confused are Keith, the singer, and his lawyers. Either way, I don’t believe the transfer of the domain is the remedy.

    Good points, Brady. The bottom line is that I know that Keith Urban’s people desperately want the domain and that it would be quite valuable to them and thus I assume that they have made the offers they have made to the painter to buy the domain have been very generous. I am confused as to why the painter would hold on to such a sparse site that does not appear to be generating much revenue when there is so much to be gained by simply picking another domain name. Thus, I feel the need to rationalize it.

    A question for those in the know: I would presume that many people visit log on to the internet looking for Keith Urban’s site and simply type in “keithurban.com,” and thus land on the painter’s site. Thus, even if the painter is not actually being confused with the singer, his site is receiving a disproportionatly high number of hits. Could this be impacting the site’s ad revenue such that it is profitable for the owner to resist selling the domain?

    In the world of websites and advertising hits=money. I haven’t looked at his site to see if he has any forms of revenue, but if he is making a profit then maybe he figures that he’ll make more money in the long run from ads then he would make by selling off the domain. The singer will only get more popular and the domain will continue to bring in some revenue. I’d have to know what the singer’s offer was before I could decide whether I’d sell the domain myself.
